Welcome to the Brique & Braque website.
These general terms and conditions govern purchases made through our online store as well as the use of our website.
By making a purchase or using our website, you agree to these terms and conditions as well as the policies related to them, including our Shipping Policy, Return and Refund Policy and Privacy Policy.
These terms and conditions apply subject to the rights and warranties provided under applicable consumer protection laws.
PART A — TERMS AND CONDITIONS OF SALE
1. Brique & Braque
Brique & Braque is an e-commerce store located in Quebec, Canada. Our products are sold online.
Our store operates on the Shopify platform, which provides us with the technology platform used to display our products, process orders and offer various payment methods.

2. Products, Descriptions and Photographs
We make reasonable efforts to ensure that the descriptions, features, prices, photographs and other information presented on our website are accurate and up to date.
Photographs are part of the information used to present a product. However, the actual appearance of an item, including its colour, may vary slightly depending on the device or screen being used.
Some products are sold in a condition other than new. They may, for example, be used, unsealed or have previously opened packaging, show signs of use or inspection, or have certain imperfections or missing pieces.
These products may notably be found in the Sale, Clearance or Damaged Deals sections and may bear, without limitation, labels such as “open box,” “unsealed,” “open packaging” or “missing pieces.”
When this is the case, we make every effort to clearly indicate the condition of the product and any relevant particularities in the product title and product page, as well as to provide photographs that allow customers to assess its condition.
It is the customer’s responsibility to review the product page before making a purchase.
Characteristics, signs of wear or imperfections clearly indicated in the description or visible in the photographs of a product that is not new form part of the condition in which the product is sold, without limiting any warranties or rights provided by law.
3. Accuracy of Information
We take reasonable measures to keep the information presented on our website accurate and up to date.
However, a typographical error, omission or inaccurate information may occasionally appear in a product page, price, promotion, availability indication or other content.
When we identify an error, we make every effort to correct it promptly.
If an error relates to an order that has already been placed, we will contact the customer when necessary and handle the situation in accordance with applicable laws.
4. Prices and Taxes
All prices displayed on our website are in Canadian dollars (CAD) unless otherwise indicated.
Applicable taxes are calculated and added at checkout in accordance with applicable tax rules.
Shipping charges and any other charges applicable to the order are displayed before the customer confirms the purchase.
Our product prices may be changed at any time for future purchases. A price change does not affect a transaction that has already been concluded, subject to the provisions of applicable law.
5. Promotions and Special Offers
Brique & Braque may occasionally offer promotions, discounts, promotional codes or other special offers.
The specific terms presented with a promotion form part of that offer, including any stated validity period, eligible products or other restrictions.
Promotions are offered subject to applicable laws and available quantities.
6. Availability and Inventory
Brique & Braque does not use direct shipping from suppliers (“dropshipping”). Products offered in our store are normally held in our own inventory.
We make reasonable efforts to keep displayed quantities up to date. Despite this, an inventory error or discrepancy may occasionally occur.
For example, a product displayed as available may ultimately no longer be available due to a quantity error, an inventory issue or orders placed within a very short period of time.
If a product that has been ordered is ultimately unavailable, we will contact the customer as soon as possible to inform them of the situation and determine the appropriate solution in accordance with applicable laws.
For certain products available in limited quantities, we may set a maximum purchase quantity. When such a restriction applies, it is communicated to the customer before the order is completed.
7. Placing and Confirming an Order
Before confirming an order, the customer has the opportunity to review the selected products and the information relating to the transaction and to make any necessary corrections.
After the purchase, an order confirmation email is sent to the address provided by the customer so that they may retain the information relating to their order.
The customer is encouraged to review this confirmation and contact us promptly if they notice an error.
Contracts entered into through our online store are subject to the rules applicable to distance contracts.
8. Information Provided by the Customer
The customer must provide the information required to process and deliver their order.
The customer is responsible for the accuracy of the information provided, including:
- their name;
- their billing address;
- their shipping address;
- their email address;
- their telephone number, when requested;
- any other information required to process the order.
If you notice an error after making your purchase, please contact us as soon as possible at info@briquebraque.ca.
If we are notified before the order is shipped, we will do our best to correct the information. However, we cannot guarantee that a change can be made to an order that has already been prepared or handed over to the carrier.
If an error in the information provided by the customer results in a problem or additional shipping charges, we will contact the customer to determine how to proceed, subject to the rights and obligations provided by law.
9. Payment
The available payment methods are displayed when placing the order.
They may include:
- major credit cards;
- Shop Pay;
- Apple Pay;
- PayPal.
Payment must be authorized in order for the transaction to be processed.
Payment information is processed by Shopify and/or the selected payment provider. Brique & Braque does not directly retain your full credit card number.
A transaction may not be completed if payment is declined, cannot be authorized or if a security mechanism prevents it from being processed.
10. Transaction Security and Fraud Prevention
To protect Brique & Braque and its customers, an order may be subject to reasonable verification when a transaction presents unusual elements or when a risk of fraud is detected.
We may contact the customer to verify certain information required to complete the transaction.
Brique & Braque may take any measures permitted by law where there are reasonable grounds to suspect fraud, unauthorized use of a payment method, false identity or any other illegal activity.
11. Gift Cards
Brique & Braque gift cards may be used to make purchases through our online store in accordance with the terms accompanying them.
They are issued in Canadian dollars and do not have an expiry date.
No usage or inactivity fees are charged on Brique & Braque gift cards.
The balance remains available until it is used.
Where the balance of a gift card may be refunded under the law, including when the applicable legal requirements are met, Brique & Braque will issue the refund upon request.
Any other terms applicable to a gift card are those communicated at the time of purchase, subject to the rights provided by law.
12. Shipping and Delivery
Brique & Braque ships its orders from Montreal.
Terms relating to processing, shipping charges, shipping methods, available destinations, shipments without tracking, international shipping and shipping delays or issues are described in our Shipping Policy.
Available shipping options and applicable charges are displayed at checkout.
Our Shipping Policy forms an integral part of these terms and conditions.
13. Returns and Refunds
Brique & Braque accepts eligible returns within 30 days of delivery, in accordance with the conditions set out in our Return and Refund Policy.
This policy notably specifies:
- eligibility requirements for a return;
- final sale products;
- terms applicable to products sold in a condition other than new;
- shipping and return costs;
- refund processing;
- the procedure applicable when a product is damaged, defective or incorrect.
We do not offer exchanges. When a return is eligible, the customer may return the product in accordance with our policy and place a new order if they wish to obtain another item.
Our Return and Refund Policy forms an integral part of these terms and conditions.
14. Final Sale Products
Some products cannot be returned simply because the customer has changed their mind.
Except where otherwise provided by law, this includes:
- collectible card games or Trading Card Games (TCG), including, without limitation, cards or sets containing Pokemon TCG, My Little Pony, Star War Unlimited, Altered TCG, Dice Masters, Soul Masters, Universus TCG, Overpower Card Game;
- blind bag products, mystery boxes or other comparable products whose contents are hidden or random;
- used products or products sold in a condition other than new when identified as final sale;
- other products clearly identified as final sale on their product page;
- products sold in the Clearance section.
The term “final sale” refers to our commercial return policy. It does not limit legal warranties or any other remedies available to a consumer when they apply.
15. Legal Warranties
All products sold by Brique & Braque benefit from the warranties provided under applicable laws.
These warranties provide, among other things, that a product must:
- be fit for the purpose for which it is normally intended;
- have a reasonable lifespan, taking into account, among other things, its price, the contract and the conditions of use;
- conform to its description and to representations made regarding it;
- be free of hidden defects within the meaning of the law.
Legal warranties also apply to used products or products that are not new. Their age, price, condition, degree of wear and any particularities communicated to the customer before purchase must then be taken into consideration.
When a characteristic, imperfection, sign of wear, opened packaging or missing piece is clearly indicated on the product page before purchase, that element forms part of the known condition of the product.
A statement such as “final sale,” “used,” “open box” or “sold as is” cannot, however, remove a warranty or remedy that cannot be excluded by law.
PART B — TERMS OF USE OF THE WEBSITE
16. Customer Account
Our store allows customers to create and use a customer account.
You are responsible for the accuracy of the information associated with your account as well as the confidentiality of the means used to access it.
If you have reason to believe that your account has been used without your authorization or that its security has been compromised, we encourage you to contact us promptly.
We may take reasonable measures to protect an account, prevent fraud or stop abusive use of the website, subject to applicable laws.
Personal information associated with customer accounts is handled in accordance with our Privacy Policy.
17. Permitted Use of the Website
The Brique & Braque website must be used lawfully and in a manner that respects its operation as well as the rights of Brique & Braque and third parties.
In particular, it is prohibited to:
- use the website for fraudulent or illegal purposes;
- attempt to gain unauthorized access to the website, an account or a computer system;
- introduce or transmit a virus, malware or any other harmful code;
- circumvent or compromise the website’s security mechanisms;
- impersonate another person;

- intentionally disrupt the operation of the website;
- use automated means abusively or for the purpose of interfering with the operation of the store;
- use the website content in violation of applicable intellectual property rights.
We may take any measures reasonably necessary to stop abusive, fraudulent or illegal use of the website.

However, the website may occasionally be temporarily unavailable or certain functions may be interrupted, including due to:

These provisions do not limit consumer rights relating to an order or a contract that has already been entered into.

In the event of a conflict with a legal provision that cannot be waived by contract, that legal provision prevails.

These terms and conditions are governed by and interpreted in accordance with the laws applicable in Quebec and Canada.
They must also be interpreted taking into account any mandatory rights granted to the consumer under the laws applicable to their contract.
